Employee injured while leaving work entitled to workers’ comp

For those who get injured while on the job in Chaska, Minnesota, workers’ compensation benefits can be a lifesaver. Workers’ comp will generally pay for medical treatment and expenses, time off work required to recover, payment for permanent injuries and disabilities and rehabilitation services. If the employee dies from a sickness or injury sustained at work, workers’ compensation benefits may cover the cost of the burial and pay a lump sum to the worker’s dependents.

A woman who was injured on her employer’s premises filed a motion for medical and temporary benefits after she was denied workers’ compensation benefits. On September 19, 2012, the woman was leaving the parking lot after her shift as a casino dealer at Harrah’s Atlantic City when she was struck by another vehicle traveling on the boulevard outside the casino.

Having been injured in the collision, the woman petitioned for workers’ compensation in October 2012. Her petition was denied by Harrah’s in January 2013. In May 2013, a Division of Workers’ Compensation judge ruled that because the woman’s car was still partially in the parking lot of the casino, the woman was still in her course of employment and therefore Harrah’s would be responsible for providing workers’ compensation benefits to the woman.

Although Harrah’s appealed the decision, arguing that the premises rule was misapplied, their appeal was denied.
